||||
| The final chapter of the Anuradha Saha death case will be written soon as all three cases (criminal case against Dr. Sukumar Mukherjee, Dr. Baidyanath Halder and Dr. Abani Roychowdhury, the "compensation" case for Rs. 143 crore against the same doctors (plus Dr. Balaram Prasad and Dr. Kausik Nandy and the AMRI hospital) and a "Contempt" petition against the West Bengal Medical Council President, Dr. Ashok Chowdhury ‘ ’ - are all pending before the Supreme Court for final adjudication. Another historic PIL (WP Civil No.316 of 2006) against "doctors' strike" ", will soon come up in the Supreme Court. OUR RECENT BATTLES AGAINST "MEDICAL NEGLIGENCE" |

|
:
1) West Bengal Medical Council (WBMC) was forced by PBT to provide
(under RTI Act) information - only ONE DOCTOR lost his/her license for medical
negligence in the past TEN YEARS out of a total of 401 complaints; 2)Recent death of a young engineer, Kuntal Chowdhury, from gross medical negligence (wrong injection in the spine)at the Woodlands Hospital,PBT has demanded that the license of the errant doctors must be immediately suspended. PBT president, Dr. Kunal Saha, sent memorandum to the Health Minister/Chief Minister/Human Rights Commission with evidence of an identical case in England where the doctor was immediately suspended and imprisoned for 8 months (British Med. J. 2003, Vol. 327, p. 697); 3) PBT has demanded an honest and expedited investigation of the death of a young house-wife, Shilpi Bangal, at the Medical College Hospital who died from blatant medical negligence from a drug allergy (SJS-TEN); 4) In a remarkable order for information under the RTI Act in the case of Mihir Banerjee vs. WBMC, the West Bengal Information Commission (WBIC) has ordered the medical council to provide all information about their investigation of complaint against the errant doctor within 2 weeks and observed that the WBMC has "shown a lackadiasical attitude maintaining that the process of reinvestigation is still going on". The WBMC has not yet provided any information to Mr. Banerjee.
At this point of time, we may not be able to provide direct financial support to any victims of malpractice. However, in the future when our financial status would permit, we will try to help financially those victims of malpractice who otherwise may not be able to afford to find justice. Service for the society by any member of PBT will never be a "work for gain" and as such, any contribution (financial or otherwise) to the society will be exclusively "charitable". The total income properties of the Society through its members or any other sources shall be used solely towards the promotion of the objectives of the Society and no portion thereof shall be paid to or divided amongst any of its members by the way of profit. As a "not for profit" organization, we hope to obtain exemption for taxes for any contribution made to the Society. A detail annual budget of the Society will be published and made available as "Public Information".

| From
the President : Dr. Kunal Saha 'The sinister medical lobby of India wants us to stop this fight against "malpractice". They also do not want that the victims of "malpractice" get the courage and start searching for justice because they want to maintain their 'untouchable" status under the umbrella of a corrupt medical council and an inept health department. There are many good and honest doctors across India. Unfortunately, the incompetent and corrupt medicos have become the medical leaders with the support from the immoral political parties. The West Bengal Medical Council has been in operation in violation of the law with the support of the devious healthcare leaders. The PBT will continue fighting these evil forces until we win this battle against the social injustice of "medical malpractice”. I urge all conscientious citizens to come forward and join us to make our hands stronger in this battle for humanity". --Dr. Kunal Saha, President, PBT |
