Supreme Court division bench of Justices H.L. Dattu and Ranjai Gogoi has granted liberty to PBT to approach Gujarat Government to investigate allegation that unopposed election of disgraced ex-MCI chief, Dr. Ketan Desai to the Gujarat University (GU) Senate was unlawful (see news below). The Apex Court passed this order today after Sr. Advocate and SC Bar Association President, Mr. M.N. Krishnamani appeared on behalf of PBT and argued that Section 58 of Gujarat University Act clearly provides that complaint against botched up election to any post in GU must be investigated by the state government. PBT has argued that GU should not have allowed Dr. Desai to run in the Senate election because his medical registration was already suspended by MCI and also because he was involved with “scandalous conduct” which should have barred him from running in university election as per GU rules. Dr. Desai’s election to GU Senate is even more important in view of them fact that by virtue of his membership to GU Senate he would automatically be nominated as a member of MCI when the new MCI is established by the government. PBT will move the Gujarat Government to investigate and remove Dr. Desai from the University Senate.
